Previous exam papers for JUR1641 and JUS5641 - Electronic Communications Law

This course changed course code from JUR5640 to JUS5640 autumn 2011, and from JUS5640 to JUS5641 autumn 2012. The change resulted in a reduction in credits from 15 to 10, but the learning requirements remained the same. The course was discontinued autumn 2018.

JUS5641 - MA:

The exam consists of two questions. Please answer both; they carry equal weight. Both questions require a comparative analysis. You should, at a minimum, assess commonalities and differences in the respective purpose and effect of these rules (or principles).

  1. Compare the ”obligations of access to, and use of, specific network facilities” in Article 12 of the Access Directive (2002/19/EC) with other available remedies identified in Articles 9 to 13a of the Access Directive.
  2. Compare the Norwegian Guidelines for Internet Neutrality (version 1.0, 2009) with the rules proposed by the US Federal Communications Commission (FCC 14-61). The texts of both instruments can be found in the attachment.

JUR1641 - BA:

The exam consists of two questions. Please answer both; they carry equal weight.

  1. Discuss the assessment of significant market power (SMP) according to Framework Directive (FD) Article 16 (4). This discussion should include an analysis of this rule’s purpose and a brief assessment of whether the rule is effective in achieving this purpose.
  2. Discuss the obligations identified in Articles 9 to 13a of the Access Directive. In particular, do these provide adequate measures for handling SMP?

  1. Critically discuss the role of National Regulatory Authorities (NRAs) in designating an actor as having significant market power. Limit your answer to NRA actions prior to determining an actor has significant market power.

  2. Critically evaluate the “toolbox of remedies” NRAs have to regulate Electronic Communications Service Providers after a finding of significant market power has been made.
