Reading list

Richard Whish: Competition law, 5th edition, London 2003. The book treats both EC and UK Law.

The students are not required to read the parts on UK law: Chapter 1, 2 (except 2 and 3), 3, 4, 5, 7, 8, 13(except 11), 14(except 6), 15(except 12), 16(except 11), 17(except 6), 18(except 6) and 21. (570 pp. in total)

Training goals

The students are expected to have good knowledge of the following topics:

  • Article 81(1) which prohibits agreements, decision by associations of undertakings and concerted practices that are restrictive of competition.
  • The criteria for exemption under article 81(3), the exemption procedure and the role and function of block exemptions
  • Article 82
  • The assessment of different types of anti-competitive conduct under Article 81 and 82:

Horizontal agreements;

  • Cartels
  • Oligopoly, tacit collusion and collective dominance
  • Cooperation agreements

Vertical agreements;

  • Abuse of dominance
  • Non-pricing practices
  • Pricing practices

  • Enforcement of Article 81 and 82 in the courts of the Member States
  • The regulation of mergers under the EC Merger Regulation

Knowledge of the following topics is required:

  • Enforcement by the European Commission of Articles 81 and 82 according to Council Regulation 17/62
  • Enforcement by the European Commission of Articles 81 and 82 according to Council Regulation 1/2003
  • Enforcement of Article 81 and 82 in the courts of the Member States according to Council Regulation 1/2003
  • Enforcement of Article 81 and 82 by national competition authorities according to Council Regulation 1/2003
