  1. Give an account of the main concerns related to the environment and human rights in the context of the current system of international investment treaties, and discuss how such concerns may be legally relevant for the determination of claims of individual investors under such treaties.
  2. Give a brief account of Most Nation Favoured (MFN)-clauses in bilateral investment treaties, and discuss whether arbitral jurisdiction under a bilateral investment treaty may be based on an MFN-clause.

Both questions shall be answered. Use approximately the same amount of time on each question.

Spring 2012

  1. Discuss the role, significance and content of the notion of ‘investment’ in international investment law and investment arbitration.
  2. Discuss the signficance of customary international law for interpretation of standards in investment treaties, particularly the expropriation and fair and equitable treatment standards.
